Do I have the right to take a leave of absence as a temporary worker?

If there is a wedding in the family or, unfortunately, a death, as an employee, you are entitled to something called "bereavement leave" or "leave of absence." It is time off to participate in activities related to that event. And as a temporary worker, you also have the right to it.

As a temporary worker, you have the right to the same benefits as your permanent colleagues. This also applies to a leave of absence (short leave). A leave of absence allows you to be absent from work without losing your salary.

There are many reasons for a leave of absence, and the website of the Federal Government lists them all: https://werk.belgie.be/nl/themas/arbeidsovereenkomsten/schorsing-van-de-arbeidsovereenkomst/oorzaken-van-schorsing-hoofde-12

Here are the most common ones:

Marriage

  • If you are getting married yourself, you are entitled to two days off in the week of your wedding or the week following it.
  • If you are not getting married yourself, it depends on who is getting married. In the case of your child, (in-law) brother or sister, (in-law) father or mother, or grandchild, you are entitled to a day off on the day of the wedding.

Death

This depends on the relationship with the deceased person.

  • For your spouse or cohabiting partner, or one of your or your partner's children, you are entitled to 10 days off. This includes 3 days between the death and the funeral, and 7 days that can be taken in the year following the death.
  • For your father or mother, father-in-law or mother-in-law, stepfather or stepmother, or those of your spouse or cohabiting partner, you are entitled to 3 days off between the death and the funeral.
  • For your (in-law) brother or sister, (great) grandfather or (great) grandmother, (great-grand)child, or a son-in-law or daughter-in-law who lives with you, you are entitled to 2 days off between the death and the funeral.
  • For your (in-law) brother or sister, (great) grandfather or (great) grandmother, (great-grand)child, or a son-in-law or daughter-in-law who does not live with you, you are entitled to a day off on the day of the funeral.
